Renting Without Risk: A Tenantʼs Guide in Odesa

Most rental problems in Odesa arise not from scammers but from verbal agreements. A two-page contract and three checks before move-in eliminate almost all of the typical conflicts.

Vetting the Landlord

First and foremost: the apartment must be rented out by the owner or by a person holding a power of attorney. This is verified with a passport and a document of ownership, and ideally also with an extract from the register, which the owner can obtain in a couple of minutes.

If the apartment is rented out by a relative, a friend, or a manager without a power of attorney, this is not a lease but an arrangement that has no legal backing. The most common scam in Odesa looks exactly like this: an apartment is rented on a daily basis and then sublet on a long-term basis to several people at once.

What the Contract Must Include

The parties and the grounds for the right to rent out the property, the address and floor area, the term, the rent amount and payment date, the indexation procedure, the deposit amount and the conditions for its return, who pays for utilities and based on which meter readings, and the conditions for early termination by each party.

A separate clause should specify who pays to repair appliances and plumbing that break down. This is the most frequent subject of disputes after move-in.

A residential lease for a term of up to three years does not require notarization; a simple written form is sufficient. However, there must be signatures on every page.

The Handover Report and the Deposit

Before the keys are handed over, a report is drawn up listing the furniture and appliances and noting their condition. The simplest way to do this is with dated photographs attached to the report.

The deposit is usually equal to one monthʼs rent. The contract must state what may be withheld from it and within what period it is returned. The wording "returned by agreement" means there is no agreement.

Utility Payments

At the time of move-in, the readings of all meters are recorded. At the same time, a certificate or screenshot confirming the absence of debt is obtained. Someone elseʼs debt for gas or heating, discovered six months later, becomes your problem in practice, even if it is not legally yours.

Building maintenance fees should be agreed on separately: in Odesaʼs new developments they are significant and by default often fall on the tenant.

What to Do in a Conflict

All agreements that change the terms should be put in writing, at least in correspondence with confirmation from the other party. Verbal consent to a delayed payment ceases to exist a month later.

Upon termination, a return report is drawn up. Without it, any claims about the condition of the apartment can be raised.

The contract clause by clause

The parties clause: full details of both, and for the landlord also the basis of their right to let, with the document reference. The subject clause: address, floor area, number of rooms and a list of what is handed over with the apartment.

The term clause: exact start and end dates. A contract without a term is far easier to terminate, and not in your favour. The payment clause: amount, settlement currency, payment date and method. If the amount follows an exchange rate, that goes in as a formula rather than as words.

The indexation clause: whether the owner may raise the rent during the term, by how much and with what notice. Without this clause the increase gets renegotiated every few months.

The deposit clause: the amount, the grounds for withholding it and the number of days for its return after you move out. The termination clause: how many days notice each side gives and what happens to the deposit in each case.

What is specific to the Odesa market

In summer some owners in the coastal districts switch their apartments to nightly rental, so a one year contract signed in May and one signed in September are different stories in terms of reliability. In May, ask directly whether you are expected to leave before the season.

In the new developments of Arkadiia and on the slopes many apartments are let by management companies rather than by owners. That is normal, but then you need the contract with the company itself and a document confirming its authority.

In the old housing stock of the centre, heating is worth a separate question. An autonomous boiler, electric heating or district heating differ several times over on a winter bill, and that is better learned in August than in December.

If you are the landlord

Vetting a tenant is the mirror image of the same procedure: passport, employment or source of income, previous home and the reason for moving. A reasonable tenant answers those questions calmly.

The deposit and the handover report protect the owner exactly as they protect the tenant. Without the report it is hard to prove that the appliances worked.

How rental income is taxed depends on how the arrangement is set up. Letting as a private individual and letting through a registered sole trader carry different rates, and over a long term the difference is noticeable.
