Terms of Use
1.General
1.1.These Terms govern the use of the website faktor24.com (the Site) and the Client Account on it. The Site belongs to FAKTOR real estate agency, operating since 2016; the Site owner is private entrepreneur Vadym Hutsu (the Agency).
1.2.By using the Site you agree to these Terms and to the Privacy Policy. If you do not agree, please do not use the Site.
1.3.The Agency may change these Terms. The new version applies from the moment it is published on this page; the update date is shown at the top.
2.What the Site is
2.1.The Site is an information catalogue of properties offered by the Agency or its partners, and a service for contacting the Agency, saving favourite properties and using the Client Account.
2.2.Information on the Site is not a public offer. Prices, areas, characteristics and availability may change; prices in foreign currency are indicative, and settlements are made in accordance with the laws of Ukraine.
2.3.The terms of the Agency's services are set out in a separate agreement between you and the Agency.
3.Client Account
3.1.The Client Account is a personal section of the Site accessed by phone number: via a link from the Agency or after entering a confirmation code sent to a messenger or by SMS.
3.2.You are responsible for keeping access to your phone and messenger secure. If a third party has gained access, notify the Agency and we will end all your sessions.
3.3.In the Account you can view property selections, save favourites, leave ratings and comments, see your own properties and their statistics, suggest corrections to listings, manage viewings, view and sign documents, and pay for the Agency's services under an agreement.
3.4.Reactions, comments and suggested corrections you leave are visible to your agent within the privacy settings you choose in the Account.
3.5.A guest link to a selection that you share with a third party allows viewing and rating without access to your data. You are responsible for whom you share the link with.
3.6.An Account session on a device is kept for up to 180 days. You can end it on all devices in the Privacy section.
4.Suggested corrections and accuracy
4.1.Any visitor may suggest a correction to a listing. A suggestion does not change the listing automatically; it is reviewed by an Agency employee.
4.2.The Agency makes efforts to keep information accurate but does not guarantee the absence of errors in data received from owners, developers or partners. Before a transaction, property characteristics are verified against documents.
5.Payment for services
5.1.Payment for the Agency's services through the Site is made only under a concluded agreement, via a link generated by the Agency, with the agreement number and date stated in the payment purpose.
5.2.Payments are processed by a payment provider; the Agency does not store your card details.
5.3.Refunds are made in accordance with the agreement and applicable law.
6.Rules of use
6.1.It is prohibited to use the Site for spam, automated data collection, attempts to access other people's accounts, false correction suggestions, or infringement of third-party rights.
6.2.The Agency may restrict access to the Account in case of violation of these Terms.
7.Intellectual property
7.1.Texts, photographs, design and software code of the Site belong to the Agency or are used lawfully. Copying Site materials for commercial use without the Agency's consent is prohibited.
7.2.Property photographs may belong to owners or developers and are used with their consent.
8.Personal data and cookies
8.1.Processing of personal data is described in the Privacy Policy. The Site uses cookies for the Account, saved favourites, language and currency, and for visitor analytics.
9.Liability
9.1.The Site is provided "as is". The Agency is not liable for interruptions of the Site, actions of payment providers and messengers, or decisions you make solely on the basis of Site information without verification against documents.
